These Terms and Conditions constitute a legally binding agreement between you and Path Spark Mesh. By accessing this website or engaging with any service offered through it, you agree to be bound by these terms. If you do not accept them, please discontinue use of this site.

1. User obligations and conduct
1.1 General conduct
You agree to interact with Path Spark Mesh and its representatives in a respectful and honest manner. Conduct that is abusive, threatening, or knowingly misleading will result in termination of any service arrangement without refund.
1.2 Prohibited activities

- — Attempting to obtain services through fraudulent means
- — Sharing session content or materials with third parties for commercial gain
- — Interfering with the delivery of services to other clients
- — Reproducing or distributing any written materials produced during sessions without consent
1.3 Content guidelines
All content shared with Path Spark Mesh — including messages and session contributions — must comply with applicable laws. You must not submit content that infringes third-party rights or contains unlawful material.
1.4 Age requirement
You must be 18 years of age or older to engage with any paid service. By making an enquiry or booking, you confirm that you meet this requirement.
2. User responsibilities
2.1 Legal compliance
You are solely responsible for ensuring that your use of this site and any associated services complies with all laws applicable in your jurisdiction. Path Spark Mesh does not warrant that content or services are appropriate for use in all locations.
2.2 Indemnification
You agree to indemnify and hold Path Spark Mesh harmless from any claims, damages, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms and Conditions or your misuse of this site or its services.
2.3 Privacy obligations
Where you disclose information about third parties during sessions, you represent that you have their permission to do so where required by law, and that such disclosure is relevant to the work at hand.
2.4 Third-party services
This site may contain links to third-party websites. Path Spark Mesh has no control over and accepts no responsibility for the content or practices of those sites. Your interaction with them is governed by their own terms.
3. Disclaimers and limitation of liability
3.1 Disclaimer of warranties
This website and its content are provided on an "as is" basis without warranties of any kind, express or implied. Path Spark Mesh does not warrant that the site will be error-free, uninterrupted, or free from harmful components.
3.2 Not a therapeutic service
The services offered by Path Spark Mesh are personal development consultancy services. They do not constitute medical, psychological, psychiatric, or clinical care. If you require professional mental health support, please seek appropriate qualified help.
3.3 Limitation of liability
To the fullest extent permitted by applicable law, Path Spark Mesh shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this site or services, even if advised of the possibility of such damages.
3.4 Force majeure
Path Spark Mesh shall not be held liable for failure to perform obligations where such failure results from circumstances beyond its reasonable control, including natural events, infrastructure failures, illness, or other unforeseen circumstances. Rescheduling will be offered where possible.
4. Legal information and dispute resolution
4.1 Governing law
These Terms and Conditions are governed by and construed in accordance with the laws of Japan. Any matters not explicitly addressed herein shall be interpreted in accordance with applicable Japanese law.
4.2 Dispute resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith communication. If no resolution is reached within thirty days, the matter may be referred to a competent court with jurisdiction in Tokyo, Japan.
4.3 Severability
If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
4.4 Modifications to these terms
Path Spark Mesh reserves the right to update these Terms and Conditions at any time. Revised terms take effect upon publication. Continued use of the site after revisions constitutes acceptance of the updated terms.
Payment, cancellation and refund procedure
Where Path Spark Mesh offers paid sessions, programmes or consultations, fees are quoted in Japanese yen and may be subject to Japanese consumption tax (currently 10 percent) where applicable. Payment is due in advance unless otherwise agreed in writing. Cancellations received more than 72 hours before a scheduled session receive a full refund; cancellations between 72 and 24 hours receive a 50 percent refund or a single complimentary reschedule; cancellations under 24 hours and no-shows are non-refundable. Refunds are processed via the original payment method within 14 business days. If a refund cannot be issued via the original method (e.g., expired card), we will contact you to arrange a bank transfer to a verified Japanese account.
Limitation of liability and indemnity
To the maximum extent permitted by Japanese law, Path Spark Mesh shall not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunity, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising from your use of our services shall not exceed the greater of (a) the fees paid by you to Path Spark Mesh in the six months preceding the event giving rise to the claim or (b) ten thousand Japanese yen (¥10,000). You agree to indemnify and hold harmless Path Spark Mesh and its representatives from any third-party claim arising from your breach of these Terms or your unlawful use of our services.
Account suspension, termination and data return
Path Spark Mesh reserves the right to suspend or terminate your access to paid services at our reasonable discretion where (i) you materially breach these Terms; (ii) we are required to do so by Japanese law, regulation, or court order; or (iii) continued provision would expose us or other users to material risk of harm. On termination, we will return or securely delete personal data we hold about you within a reasonable period, save for records we are legally required to retain. Termination does not affect rights or obligations accrued before the date of termination, including any outstanding payment obligations.
