Terms of Service

These Terms of Service govern your use of the Path Spark Mesh website and the personal development services offered through it. By accessing or using this site, you agree to the terms set out below. Please read them carefully before proceeding.

1. Service usage terms

This website and the services offered through it are intended for personal development purposes. You agree to use the site and services honestly, in good faith, and in a manner consistent with applicable law.

  • Reproducing, distributing, or commercially exploiting site content without written permission

1.3 Access requirements

You are responsible for ensuring that your access to this site complies with any laws applicable in your jurisdiction. You must be at least 18 years of age to engage with any paid service.

Session materials and written deliverables provided as part of a service engagement are for your personal use only. They may not be shared commercially or published without permission.

2.1 No account required

This website does not require account registration. Contact is made via the contact form, and session arrangements are handled through direct correspondence.

2.2 Communication responsibility

You are responsible for ensuring that the email address you provide is accurate and accessible. Path Spark Mesh bears no responsibility for missed correspondence resulting from incorrect contact details.

2.3 Session cancellation

Cancellation terms for individual sessions and programmes are set out in the service agreement provided before any booking is confirmed. These terms are agreed between the parties prior to payment.

2.4 Right to decline

Path Spark Mesh reserves the right to decline to enter a service arrangement with any individual at its sole discretion and without obligation to provide a reason.

3. Service availability and modifications

3.1 Availability

While we aim to keep the site available at all times, we do not guarantee uninterrupted access. Scheduled maintenance, technical issues, or circumstances beyond our control may occasionally affect availability.

3.2 Modifications

Path Spark Mesh reserves the right to modify, update, or discontinue any aspect of the website or services at any time. Where changes affect existing service agreements, clients will be notified directly.

3.3 Geographic availability

Remote sessions are available internationally. In-person sessions are available to those based in or visiting Tokyo, Japan. Geographic restrictions may apply to certain service formats at our discretion.

4. Intellectual property

4.1 Site content ownership

All written content, structure, design, and materials on this website are the property of Path Spark Mesh unless otherwise stated. Reproduction for commercial purposes requires written permission.

4.2 Session deliverables

Written summaries, maps, and other materials produced during or after a session are provided to you for personal use. You may not publish, distribute, or resell these materials without prior written consent.

4.3 Your submitted content

Content you submit via the contact form or during sessions remains your own. By submitting it, you grant Path Spark Mesh permission to use it solely for the purpose of responding to your enquiry or providing the agreed service. No other use is made of it.

4.4 Changes to these terms

These Terms of Service may be updated periodically. Continued use of the site following any update constitutes acceptance of the revised terms. Significant changes will be indicated by a revised date at the top of this page.

Service availability, modifications and force majeure

Path Spark Mesh provides its services on a reasonable-endeavours basis. While we work to keep our website and consultation channels available, scheduled maintenance, dependency outages (hosting, telephony, payment processors), public-holiday closures and events of force majeure (including but not limited to natural disasters, infrastructure failure, public-health emergencies and government action) may interrupt availability without prior notice. We will not be liable for damages arising from such interruptions, and any pre-paid sessions affected by a confirmed outage will be rescheduled or refunded pro-rata in line with our cancellation policy.

Intellectual property, content licence and acceptable use

All text, photographs, layouts, illustrations, code and trademarks displayed on this website are the property of Path Spark Mesh (or our licensors) and are protected under Japanese copyright and trademark law as well as international treaties. You are granted a limited, non-exclusive, non-transferable licence to view and print pages for personal, non-commercial use only. You may not (a) reproduce, redistribute, mirror or publicly display our content in any form without our prior written permission; (b) use our content to train machine-learning models without an explicit licence; (c) submit content via our forms that is unlawful, defamatory, harassing or that infringes third-party rights; or (d) interfere with the security or integrity of our site (including probing, scanning or attempting to bypass authentication).

Governing law, dispute resolution and severability

These Terms are governed by the laws of Japan, excluding its conflict-of-law provisions. The Tokyo District Court shall have exclusive jurisdiction of first instance over any dispute arising from your use of Path Spark Mesh, unless mandatory consumer-protection laws in your place of residence direct otherwise. Before formal litigation, both parties agree to attempt good-faith resolution through written correspondence for at least thirty (30) calendar days. If any provision of these Terms is held invalid or unenforceable by a competent court, that provision shall be struck only to the extent necessary, and the remainder shall continue in full force and effect.
